These Terms & Conditions ("Terms") govern your use of TextElixir (the "Service"), operated by Chariot of Earth LLC ("we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
TextElixir is an AI-powered messaging assistant that helps users craft and refine text messages and conversational replies. Outputs are generated by AI models and provided "as is" for your personal use.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. You are responsible for keeping your login credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.
You agree not to misuse the Service. You will not:
AI-generated outputs may be inaccurate, biased, or inappropriate. You are responsible for reviewing and deciding whether to use any output. The Service is not a substitute for professional advice (legal, medical, financial, or otherwise). You retain responsibility for the prompts you submit and for how you use any generated content. You must have the right to submit any content you provide as input.
We retain all rights, title, and interest in the Service, including its software, design, and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your personal, non-commercial use during your active subscription.
Premium features are offered on a recurring monthly subscription. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation, and refund mechanics, please see Paddle's Buyer Terms.
Subscriptions renew automatically each billing period until canceled. You can cancel at any time through Paddle's customer portal at paddle.net or by contacting support@textelixir.com.
We aim to keep the Service available and reliable but do not guarantee uninterrupted, error-free, or uniformly available performance. Features may change, be added, or be removed over time.
We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious violations of our acceptable use rules. You may stop using the Service at any time by canceling your subscription and closing your account.
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us for the Service in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, special, incidental, or punitive damages, including loss of profits, data, or goodwill.
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your misuse of the Service, your content, or your violation of these Terms.
We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, by notifying you in-app or by email. Continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of the United States and the state in which Chariot of Earth LLC is registered, without regard to conflict of law principles. Disputes will be resolved in the courts of competent jurisdiction in that state.
